When I’m asked this question, I tell people: Trust Your Instincts. Are you seeing any red flags? YOU know your child best!
If you answer YES to any of these questions, you need at least a consult with a special education attorney at GDPC:
- Has your child been denied an IEP?
- Has your child received years of AIS or RTI?
- Is your child complaining about peers or bullying?
- Does your child have few friends or difficulty socializing?
- Is he/she struggling to complete nightly homework?
- Does your child have behaviors that are interfering with their learning?
- Does your child have failing or near failing grades?
- Has your child made little or no progress in speech/OT/PT, or other related service?
- Is it hard to get your child to school in the morning?
- Has your child been repeatedly disciplined by the school?
- Are your child’s IEP goals repeated year after year?
- Are your child’s IEP goals abandoned even if they are not achieved?
- Have you been denied data or work samples as it relates to your child’s IEP goals?
- Has your district denied you assessments or evaluations that make sense?
- Is your district’s CSE refusing to listen to a private doctor or provider’s advice or recommendations?
- Have you seen a change in your child’s mood, disposition, or self-esteem?
- Is your child 14 or 15 years old, without a transition plan on his/her IEP?
- Is your child expected to graduate, but unable to be independent?
You should know what your rights are and what your child is entitled to. Your district is likely on the hook for more than you think.
